NEW YORK — New City Taxi and Limousine Commissioner Matthew Daus has sent a letter to Avis/WeDriveU vice president for government affairs and counsel Robert Muhs asking the rental car company to clarify Avis’ plans for its chauffeured drive service in New York City.
This is the second letter that the commissioner has drafted to Avis about this matter. A previous letter dated May 13, 2009, did not elicit a response from Avis. This letter has requested a formal written response from Avis no later then Sept. 25.
Industry associations have requested that the commissioner rule on the legality of the Avis model in New York City. The Port Authority of New York/New Jersey has previously ruled that Avis/WeDriveU violates the permitting privileges between the authority and Avis. The industry association would like the commissioner to formally take a stand on this issue to further understand the legality of the Avis model in New York City.
Industry associations and chauffeured transportation companies have racked up consistent victories over the Avis model in other cities when challenging it before municipal and regulatory authorities. At issue is the fact that Avis circumvents the licenses, fees, safety rules, and regulations that apply to chauffeured transportation companies, thereby giving them an unfair competitive advantage.
