NLA Exposes Alarming TNC Terms & Conditions

MARLTON, N.J.—–The National Limousine Association (NLA) in an effort to heighten public awareness about the dangers of riding in TNCs, issued a press release July 14 highlighting the alarming terms and conditions listed on the websites of Uber, Lyft, VIA and Whisk. The NLA stated that its main initiative is to ensure that the integrity of the ground transportation industry is preserved and the safety of passengers and drivers are protected. It is imperative to think twice before you app.

“The National Limousine Association has worked diligently to ensure that safety standards are universally enforced across the entire ground transportation industry,” said NLA President Gary Buffo (Pure Luxury Transportation, Petaluma, Calif)). “It is our objective that all ground transportation, including TNCs, perform under the same standards as private and pre-arranged ground transportation drivers. Upon closer inspection, several TNC terms and conditions reveal a number of disturbing provisions that should give any passenger pause.”

From Uber’s Terms and Conditions

Note: “Third Party Providers” = The Drivers

  • “Uber does not guarantee the suitability, safety or ability of third party providers.”
  • “By using the services, you acknowledge that you may be exposed to situations involving third party providers that are potentially unsafe, offensive, harmful to minors or otherwise objectionable, and that use of third party providers arranged or scheduled using the services is at your own risk and judgement.”

From Lyft’s Terms and Conditions

  • “Users understand and accept that LYFT has no control over the identity or actions of the riders and drivers, and LYFT requests that users exercise caution and good judgement when using the services. Drivers and riders use the services at their own risk.”

From VIA’s Terms and Conditions

Note: “You” = The Passenger(s)

Note: “Third Party Providers” = The Drivers

  • You assume all risk associated with dealing with third party providers. You agree to resolve disputes directly with the other party. You release VIA of all claims, demands, and damages in disputes among users of the Service.”

From Whisk’s Terms and Conditions

  • “Whisk assumes no liability for any acts on the part of the driver

 “For many years, ground transportation operators have adhered not only to national, state and local regulations, but also to strict personal standards and regulations as well,” said Buffo. “The NLA encourages its members to do all they can to protect the safety and privacy of both their passengers AND their drivers. These examples from the Terms & Conditions of ride-hailing app services show a disturbing lack of concern and responsibility for both. The Ride Responsibly initiative was launched precisely for these reasons, and operators should be accountable for the well-being of passengers and drivers universally, to the best of their abilities, and to the full extent of the law, he added.
