New Health Law Clears the Air and Prohibits Smoking

Public health laws now give owners or operators of limousines for public hire the power to prohibit smoking in their vehicles.

The newly amended law specifically provides that owners of public transportation facilities may, and in some instances must, prohibit smoking in their vehicles. Limousines for private hire are included in the definition of public transportation. Problems may arise for a limousine operator if a vehicle is hired by several unrelated individuals, some of whom are smokers and some of whom are not. it may be necessary for the operator to prohibit smoking by all passengers.

Chauffeurs may also be prohibited from smoking in the vehicle, whether or not the vehicle is occupied by a passenger. in order to abide by the law, operators should post "No Smoking" signs in the vehicle, and advise customers of the policy prior to booking a job. Violations of the law could result in fines up to $500.
