New Jersey Ordinance Challenged in Court

DOVER, N.J. — The owners of four taxi and limousine companies registered in Dover have sued in Superior Court in Morristown to challenge the constitutionality of the town's new ordinance. The ordinance caps the number of registered vehicles at 12 per company, limits the age of the vehicles to 10 years, seeks to limit out-of-town companies operating in the town, and requires operators to "speak, read and write the English language fluently." The wording of the latter requirement since has been amended.

Town officials argue that the ordinance was not meant to hurt businesses but to address public safety issues. The ordinance, Mayor James Dodd said, "was in response to the public's outcry" regarding safety issues and "the way taxi drivers conducted themselves in the town."
